Patent Fee Increases in North America: Practical Impact for Patent Portfolios

The USPTO and CIPO will implement increased patent fees in 2025. The CIPO changes take effect on January 1, 2025, with USPTO following on January 19, 2025. These increases will significantly impact patent maintenance, filing, and examination costs, making it critical to assess portfolios and plan ahead.

Key Fee Changes to Note

United States (USPTO):

  • Maintenance fees will increase by up to 7.5% for all renewal stages.
  • Additional increases for continued examinations and other filings add further costs.

Canada (CIPO):

  • Maintenance fees for years 10-14 rise from 347 CAD to 362.27 CAD, with larger increases for later stages.
  • Filing, examination, and excess claim fees are also increasing.

What This Means in Practical Terms

Here are some scenarios for different sized patent portfolios.
